Mosher v. Mosher (Mississippi 2016)

A child support issue must be properly raised in the lower court or it is procedurally barred from appellate review. The lower court has an obligation to review all child support agreements to ensure the support amount is adequate and sufficient to support the child. In this case, the agreed-to amount was less than the presumptive amount, and the lower court found it inadequate and raised the support to the presumptive amount. The appellant did not challenge this finding in the lower court, and the appellate court did not consider his argument on appeal. Notwithstanding the bar, the appellate court found no abuse of discretion in the lower court’s decision.
