Nguyen v. Heller-Nguyen (North Carolina 2016)

Vested child support arrears are not subject to offset. In this case, the court appointed a parenting coordinator to assist the parents with custody issues. The mother failed to pay the coordinator, and the coordinator requested to be released from the case. The court then ordered if the father paid the coordinator on mother’s behalf, his arrears would be reduced by the amount of the payment. Because these arrears were already due and owing, this was not appropriate.
