An incarcerated parent is considered voluntarily underemployed or unemployed and is not excused from paying child support while in prison. The NCP in this case was incarcerated for 51 months. When this order was established, the Court should have calculated the proper amount of support for that period of time and included the amount in the award of retroactive support.
